Writ petition filed demanding to ensure housing rights and justice of landless squatters

Kathmandu. A writ petition has been filed at the Supreme Court demanding to ensure justice and right to housing of landless squatters across the country. Senior advocate Dinesh Tripathi has filed a writ petition at the apex court challenging the government’s move to forcibly evict landless and landless squatters without making proper alternative arrangements.

The preliminary hearing of the writ petition has been fixed for April 29. Senior advocate Tripathi has sought a ‘mandamus’ order not to evict the landless squatters from their settlement on the basis of the recent directive of the Prime Minister or any decision and to make arrangements for alternative settlement before evicting them. The petition also calls for the state to formulate a concrete and nationwide master plan to ensure the rights of landless citizens.

They have demanded that no citizen should be forcibly evicted from their residence without proper alternatives and due process of law. The petitioner has demanded the government to issue an interim order as per Rule 49 of the Supreme Court Regulations-2074 not to remove the squatters from squatters in any settlement of the country including Kathmandu and not to implement any notice or circular related to this until the final settlement of the case.
