Kathmandu. The government has decided to release KP Sharma Oli and Ramesh Lekhak on present bail. The police have decided to release both of them as per the mandamus order of the Supreme Court.
An official at the District Police Range, Kathmandu, told Ratopati that it was decided to release Oli and the writer “to be present during the search” with the consent of the public prosecutor.
Police had arrested them on March 24 after the Gauri Bahadur Karki-led commission formed to investigate the incident of September 23 and 24 recommended to investigate into the criminal case. The Kathmandu District Court had remanded them in custody for the third time.
Hearing the habeas corpus petition, the Supreme Court had issued a mandamus order on April 23 not to extend the custody of the accused for the fourth time and to release him from custody if the investigation is not completed. As per the Supreme Court’s order, the third deadline extended by the Kathmandu District Court was only till Wednesday.
A division bench of Justices Binod Sharma and Sunil Kumar Pokharel had ordered the release of the accused after April 25.
The Kathmandu District Court had issued a five-day remand to the court for the third time effective from April 4. The apex court had issued a mandamus order to complete the investigation and release them from custody after completing the process under Section 15 of the Civil Criminal Procedure Code-2074 and to conduct further investigation.
The Council of Ministers had decided to implement the recommendations made by the Gauri Bahadur Karki Commission on September 7 and 24. Oli was the prime minister and the writer was the home minister when teenagers were killed in police firing in Baneshwor, Kathmandu.
Oli was admitted to the Tribhuvan University Teaching Hospital due to health problems. The writer was detained at the Armed Police Force No. 2 battalion in Maharajgunj.
