Kathmandu. The Supreme Court has scheduled the hearing on the habeas corpus petition filed by medical practitioner Durga Prasai. A division bench of Justices Manoj Kumar Sharma and Meghraj Pokharel is scheduled to hear the case on Tuesday.
Earlier on Monday, the Supreme Court had issued an order to bring the related files from the Office of the Attorney General. The court ordered to summon the file on the basis of the written reply sent by the District Police Range during the preliminary hearing on the habeas corpus writ filed on behalf of Prasai.
In Prasain’s case, Uma Prasain had filed a habeas corpus petition naming District Police Range, Bhadrakali, Kathmandu as the defendant. Before his arrest, Prasain had filed a writ petition on February 14, demanding to stop the arrest against him. The apex court had sought a written response from the Election Commission and the District Police Range, among others. Two writs filed by Prasain are being heard together.
Earlier, Prasai, who was arrested on February 7, was released on present bail. At that time, his statement related to the election was taken on the basis of investigation by the Cyber Bureau of the police.
Police have been arresting Prasai time and again on the suspicion of launching a campaign to disrupt the elections scheduled for March 4. Earlier, Prasain, who was arrested from Pokhara on January 5, was released after his statement.
