Kathmandu. The Supreme Court (SC) has ordered the government to produce the original file filed by Durga Prasain, coordinator of the Campaign to save the nation, nationality, religion and culture.
A division bench of Justices Nahakul Subedi and Meghraj Pokharel on Monday ordered the police to produce the original file along with the decision sent by the Election Commission to take action.
Prasai had filed a writ petition naming District Police Range, Kathmandu as the defendant.
In a written reply to the Supreme Court, the Range had stated that they were arrested as per a letter sent by the Election Commission on February 17.
“It has come to light that the petitioner (Durga Prasai) was arrested as per the EC’s letter dated February 17 for investigation, so the original file along with the decision of the commission to take action against Prasain should be brought through the Office of the Attorney General,” the SC order reads.
It has also ordered the hearing of the petition on Tuesday.
Following a letter from the Election Commission, a team from the Range had arrested Prasain on February 17.
He is currently in the custody of the premises.
