KATHMANDU: Minister for Law, Justice and Parliamentary Affairs Sobita Gautam has said that preparations are underway to amend the law for the declaration of death and registration of the deaths of those missing in the Bhotekoshi-Trishuli disaster.
Speaking at a meeting of the Parliamentary Special Committee on Climate Change, Climate Justice and Bhotekoshi-Trishuli Disaster on Tuesday, Minister Gautam said that the existing laws should be amended for the declaration and registration of deaths.
She said preparations were underway to make the process of declaration of the death of the people disappeared due to natural disasters easier by amending the Civil Code and Civil Registration Act and other laws relating to declaration of death.
She said, “Now because there is this provision in the law, in the main law, in the act, it has to be amended. The Parliament session has ended. Now, through this ordinance, the government will soon decide where to put the Civil Code, the Registration Act or what happens in the disaster, we are making laws regarding the declaration of death and the registration of deaths.” ’
According to him, the staff of the Ministry of Law has already prepared a solution after holding in-depth discussions on this issue.
“Preparations have been made, our staff sir and madam have discussed it intensively and found a suitable solution,” she said.
Minister Gautam said that although Nepal has been continuously facing the threat of disaster for the last 10-12 years, it has not been taken seriously enough. Giving examples of disasters in Jure, Melamchi, Thame and Roshi Khola areas of Sindhupalchowk, she said that the floods in Bhotekoshi and Rasuwa have made everyone more aware.
She said, “While making laws, we should keep the disaster at the center. Not only the law, but whatever we do, now we have to keep the disaster at the center.” ’
Minister Gautam stressed on the need of coordination with ministries concerned regarding weather forecast, relief package, facilitation to industrialists and protection of children who have lost their families in disasters for disaster management.
She said that the parliamentary special committee is an all-party committee and the concerned ministers should be called and the necessary ways of resolving the disaster should be taken into consideration.
