Kathmandu. In today’s meeting of the House of Representatives, lawmakers have demanded a law to give death penalty to rapists. <\/p>\n
They argue that although it contradicts Nepal’s commitments on the constitution and human rights, the parliament should have the power to break them. Recalling the incident of rape and murder of a three-year-old girl in Bara, the lawmakers stressed the need to amend the Act as per the time. <\/p>\n
The demand for stringent punishment for the culprits has intensified from the streets to social media and the parliament over the murder of a girl child in Bara. Home Minister Sudhan Gurung, Law Minister Sobita Gautam and five other ministers signed a three-point agreement with the victim’s family in the middle of the night. <\/p>\n
According to the agreement, the process of forming a seven-member Judicial Resolution Committee has been forwarded to review the provisions of punishment in the existing laws and give suggestions. <\/p>\n
Minister for Law, Justice and Parliamentary Affairs Sobita Gautam has written on social media that Article 16920 of the Constitution of Nepal prohibits the making of laws imposing the death penalty. However, legal experts say that the problem is not in the provision of punishment but in the poor investigation and enforcement of the police. <\/p>\n
According to Section 41 (f) of the Criminal Code, a person guilty of murder after rape can be sentenced to life imprisonment as long as he is alive. Further reforms in some laws and effective implementation of existing laws can reduce the incidence of rape or take action against the perpetrator. <\/p>\n
Legal experts say the current sentence is adequate, but a lack of expertise and sensitivity in police investigations and a lack of trust in prosecutors are the main challenges. Therefore, experts say that the right way to give justice to the victims is to make the investigation process efficient and impartial rather than demanding stricter laws<\/p>\n","protected":false},"excerpt":{"rendered":"
