Kathmandu. The Supreme Court (SC) has dismissed a writ petition filed by the then Prime Minister KP Sharma Oli over his refusal to recite the phrase ‘I promise’ while taking oath of office and secrecy. <\/p>\n
Senior Advocate Dinesh Tripathi, Dr. A division bench of Justices Binod Sharma and Sunil Kumar Pokhrel gave the verdict today by a division bench of Justices Chandra Kanta Gyawali and Raj Kumar Suwal and advocates Nawaraj Adhikari, Santosh Bhandari, Lokendra Bahadur Oli and Sita Shrestha. <\/p>\n
When the then Prime Minister Oli took the oath of office and secrecy from the then President Bidya Devi Bhandari, the language of the oath of office was not included in the swearing-in language. On May 14, 2008, while taking oath as the Prime Minister, Oli had said that the phrase ‘I promise’ was not needed, which led to protests and criticism from the streets to the parliament. <\/p>\n
A writ petition has been filed at the Supreme Court demanding that Oli’s oath of office and secrecy be revoked and sworn in as per the legal framework. The petitioners had argued that Article 80 of the Constitution of Nepal was disrespectful of the oath-taking provision. <\/p>\n
Oli had removed the word ‘I promise’ by bringing an ordinance related to oath of office following a controversy over ‘I promise to take oath’. After controversy and criticism at that time, the Oli-led government had issued the ‘Ordinance on Oath-Taking-in-2078’. <\/p>\n
Section 3 (2) of the ordinance had amended the provision of the oath format to say, “I….. I take oath in the name of God, country and people with full loyalty to the Constitution of Nepal, where the sovereignty and sovereignty of Nepal is vested in the Nepalese people.”<\/p>\n","protected":false},"excerpt":{"rendered":"
