KATHMANDU: A writ petition has been filed at the Supreme Court (SC) demanding the return of expenses incurred by senior state officials for medical treatment abroad. <\/p>\n<p>A writ petition has been filed at the Supreme Court, arguing that the medical expenses of the senior officials of the state who go abroad for treatment against the prevailing law have been paid from the state treasury and it is wrong. <\/p>\n<p>According to SC spokesperson Arjun Koirala, the writ petition has been filed demanding the return of the expenditure incurred from the state coffers that are against the Public Health Act. <\/p>\n<p>The writ petition filed by Saroj Kumar Neupane has been filed by the Office of the Prime Minister and Council of Ministers, as well as former President Dr. Former prime ministers Ram Baran Yadav, former prime ministers KP Sharma Oli, Jhalanath Khanal and Sujata Koirala have been named as defendants. <\/p>\n<p>However, President Ram Chandra Poudel, who has been paid for the medical treatment of similar nature, has not been made a defendant in the case. A preliminary hearing on the writ petition filed on Thursday will take place on Friday. <\/p>\n<p>The Supreme Court (SC) had on April 14 struck down a legal provision allowing former VIPs of the state to pay money from the state treasury for medical treatment abroad. <\/p>\n<p>The Constitutional Bench had decided to scrap the provision in the working procedure that was in contradiction with the constitution and the Act. <\/p>\n<p>The former state officials had been in the habit of going abroad for treatment even though they were in a position to get treatment in the country and bear their medical expenses through the decision of the cabinet. Although such activities were banned by promulgating the Public Health Act in 2075 BS, according to the provision of another working procedure, special officials used to get treatment abroad. <\/p>\n<p>The Supreme Court (SC) has annulled Clause 12 (1) of the Civilian Relief, Compensation and Financial Assistance (Second Amendment) Procedure, 2073 BS. According to the clause, the government would bear the expenses of the treatment of former VIPs abroad. <\/p>\n<p>The definition of VIPs includes former presidents, vice-presidents, prime ministers, speakers, chief justices, former deputy speakers, deputy prime ministers, ministers, state ministers, assistant ministers, lawmakers and constitutional officials. <\/p>\n<p>The Supreme Court had only scrapped the provision in the working procedure. Advocate Radika Chamlagain had argued in the writ petition that the working procedure was in conflict with two articles of the constitution and an act, arguing that the procedure allowing VIPs to get treatment abroad should be scrapped. <\/p>\n<p>Similarly, Clause 30 of the Public Health Act, 2075 BS states that the Nepal government shall not bear the expenses required for treatment of any person in a foreign country.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kathmandu.
